Measures, regulating the status of foreign citizens and stateless persons in Russia in connection to the danger of further spread of new coronavirus infection (COVID-19) introduced by the Presidential Order on the 18th of April 2020 and allowing foreigners to stay in Russia until December 15, 2020 (provided expiration date of their immigration documents fell in the period between March 15, 2020 and December 15, 2020) have now been extended until June 15, 2021.
This will continue to be applicable to the following types of immigration documents:
- Visas (all types);
- Address Registration – temporary and permanent*;
- Migration cards;
- TRP (Temporary Residence Permits);
- PRP (Permanent Residence Permits);
- Documents, confirming refugee status, status of the “mandatory moved person”, participant of the state program for relocation of compatriots living abroad);
According to the Order, in case expiration date of the immigration document falls in the period between March 15, 2020 and June 15, 2021, such document is automatically extended for 458 days after the document expiration date. This gives opportunity to the owner of the document to stay in Russia for 458 days after the immigration document expiration date.
*We think that in practice registrations will be extended until June 15, 2021 as was the case with the previous Presidential Order.
Foreign citizens, who are currently in Russia can exit Russia and enter their native country without the need to travel through third countries (with which at the moment air communications have been restored and borders opened).
ATTENTION: According to the Presidential Order automatic extension of migration documents for 458 days will be applicable only to citizens (permanent residents) of those countries, with which transport communications have not yet been restored.
In case transport communication with the country of person’s citizenship or permanent residence is restored, such foreign citizen has 90 days (from the date of the President Order – 17 December 2020 or from the date when transport communications will be restored) in order to depart from the Russian Federation. No additional immigration documents will have to be procured in such cases.
The Order is not applicable to the following types of migration documents*:
- HQS work permits;
- Work Permits;
- Corporate Work Permits;
- Patents (in case patent has expired in the period from March 15, 2020 till June 15, 2021, – it will be possible to apply for patent extension without having to leave the Country, irrespective of the initial purpose of entry);
*Holders of these immigration documents and their employers have to file for extension in the standard manner.
For the same period (from March 15, 2020 till June 15, 2021) is suspended the flow of the 6 month period of permitted stay abroad for the following categories of foreign citizens and stateless persons:
- participants of the state program for relocation of compatriots living abroad;
- persons having permanent residence permits;
- persons having temporary residence permits;
